Assistant State's Attorney Kevin Wiggins maintains it was Avi Werdesheim who struck Corey Ausby on the head with a radio, injuring him, according to the Sun report.
But during testimony, Eliyahu Werdesheim said his brother was not involved in the confrontation with Ausby, it states.
According to the report, Eliyahu Werdesheim said he deflected Ausby's arm after Ausby tried to hit him with a piece of wood with nails protruding from it. Eliyahu Werdesheim said he then struck Ausby on the head with a two-way radio.
That radio was issued to him by Shomrim of Baltimore, a neighborhood watch group of Upper Park Heights residents.
At the time, Werdesheim was patrolling the neighborhood as a member of Shomrim.
The group monitors Upper Park Heights and Greenspring in Baltimore City and Baltimore County, as well as in Pikesville, according to its website.
Avi Werdesheim was not a member.
